TERMS AND CONDITIONS OF USING THE ELEMENTS CASINO SURREY

1. DEFINITIONS

   In these Terms and Conditions, the following definitions apply:

• "Casino" means Elements Casino Surrey;
• "Customer" or "You" refers to any person who uses the services of the Casino;
• "Gaming Floor" means the area where gaming activities are conducted within the Casino.

2. AGREEMENT TO TERMS AND CONDITIONS

By entering and using the Gaming Floor, You acknowledge that You have read, understood, and agree to be bound by these Terms and Conditions.If You do not wish to accept any or all of these Terms and Conditions, please leave the Gaming Floor immediately.

3. AGE RESTRICTIONS

   The minimum age for accessing and participating in gaming activities at the Casino is 19 years old (the "Minimum Age"). If You are under the Minimum Age, You must leave the Gaming Floor immediately.The Casino reserves the right to request proof of Your identity or age before allowing access.

4. ACCESS RESTRICTIONS

   Access to the Gaming Floor may be restricted in accordance with applicable laws and regulations.If You are excluded from gaming activities at any casino licensed by the British Columbia Lottery Corporation (BCLC), You must not attempt to use the Casino's services.

5. GAMING RULES AND REGULATIONS

The Casino is subject to all applicable laws, rules and regulations in force from time to time.You agree to comply with these Terms and Conditions as well as any instructions or directions given by the staff of the Casino at all times while You are on the Gaming Floor.

6. USE OF TABLES AND MACHINES

• The use of tables and machines is governed by applicable rules and regulations;
• The Casino may designate certain areas for gaming and non-gaming activities;

7. LIABILITY AND RESPONSIBILITY

   The Casino disclaims all liability for any loss or damage arising from:(a) Your failure to comply with these Terms and Conditions;(b) any acts or omissions of other customers at the Gaming Floor; (c) Your participation in gaming activities.

8. SECURITY

• The Casino has implemented security measures designed to protect its premises, staff, and patrons from theft and damage;
• You agree not to tamper with or interfere with these security systems;

9. RESPOINSIBLE GAMBLING

The Casino supports responsible gambling practices and encourages customers to gamble within their means.You acknowledge that excessive gaming can lead to financial difficulties.

10. AMENDMENTS TO TERMS AND CONDITIONS

    These Terms and Conditions may be amended at any time, without prior notice to You, by posting updates on the premises or communicating changes verbally or in writing.Please check with staff for updated information about these Terms and Conditions.

11. GOVERNING LAW

• These Terms and Conditions shall be governed by and construed in accordance with all applicable laws of Canada;
• The courts having jurisdiction over matters arising from these Terms and Conditions shall have the right to hear such disputes.

12. ENTIRE AGREEMENT

These Terms and Conditions constitute the entire agreement between You and the Casino regarding access and use of the Gaming Floor.Any prior or contemporaneous agreements, representations or understandings are superseded by this document.

13. BINDING EFFECT

    Your continued participation in gaming activities at the Casino constitutes Your acceptance to be bound by these Terms and Conditions.

14. DISCLAIMERS AND LIMITATION OF LIABILITY

• The Casino does not guarantee any winnings;
• In no event shall the Casino or its directors, officers, employees or agents be liable for direct, indirect or consequential damages arising from access and use of the Gaming Floor;
  • Any warranties implied by law are hereby disclaimed.

15. GOVERNING PROVISIONS

If a provision in these Terms and Conditions is deemed unenforceable under applicable laws or regulations, it shall not affect any other provision, which shall remain enforceable.In case of dispute with regards to the interpretation of these Terms and Conditions, You agree that the British Columbia courts have jurisdiction.

16. RIGHT TO REFUSE

The Casino reserves the right to refuse access to any individual at its discretion, without prior notice or liability for doing so.

17. RIGHT TO AMEND

    The Casino may unilaterally cancel or amend its services as deemed necessary.You agree that such action does not constitute a breach of these Terms and Conditions.

18. ACKNOWLEDGMENT OF AGREEMENT

Your participation in gaming activities at the Casino constitutes Your acceptance to be bound by these Terms and Conditions, which are intended solely for Your protection.Please refer to other applicable terms or agreements when dealing with the Casino's affiliates or partners.
